Regulación de las criptomonedas alrededor del mundo.

Los recientes avances normativos, incluida la publicación del acuerdo provisional sobre los mercados de criptoactivos (MiCA) en la UE y la publicación del Marco para el Compromiso Internacional sobre Activos Digitales en EE.UU., señalan el deseo de proporcionar claridad normativa en este espacio. En el futuro, la adopción de criptomonedas y stablecoins estará probablemente relacionada con el nivel y la calidad de la regulación en una jurisdicción determinada.

Dado que la seguridad normativa influye en el comportamiento económico, las grandes regiones económicas como la UE y los EE.UU. están dando pasos para proporcionar una orientación inicial.

La regulación de las criptomonedas es clave.

A medida que el sistema financiero tradicional se conecta con el floreciente ecosistema de las criptomonedas, la creciente interconectividad suscita la preocupación por los efectos secundarios que podrían afectar a la estabilidad del sistema.

Además, la naturaleza de la tecnología subyacente de las criptomonedas es tal que permite realizar transacciones transfronterizas sin necesidad de ningún intermediario financiero o de los existentes.

Las nuevas aplicaciones y modelos como la tokenización, las finanzas descentralizadas, los NFT (tokens no fungibles) y las organizaciones autónomas descentralizadas desafían los modelos tradicionales que delimitan quién se considera actualmente una “persona”, qué es el “valor” y cómo se puede transaccionar este “valor. Esto amenaza con entrar en conflicto directo con las regulaciones existentes relativas a los flujos de datos transfronterizos, los derechos de propiedad intelectual y los controles de capital. También podría generar ambigüedad en el ámbito fiscal, además de plantear una serie de otros problemas políticos.

El camino a seguir

La Orden Ejecutiva de la Casa Blanca es un paso notable en la dirección correcta para permitir la colaboración entre agencias. Un enfoque coordinado a nivel mundial, que abarque la cooperación internacional en torno a la regulación de los criptoactivos, será óptimo desde el punto de vista económico, protegerá a los consumidores y evitará el abuso de las criptomonedas para actividades ilícitas.

El Consorcio para la Gobernanza de las Monedas Digitales del Foro, compuesto por más de 80 organizaciones y que representa a diversos sectores y geografías, está trabajando con este fin. Ha centrado su segunda fase de trabajo en el examen de las repercusiones macroeconómicas de las monedas digitales y en la elaboración de enfoques reguladores para las mismas, mientras las partes interesadas siguen experimentando con estos instrumentos y la adopción de criptomonedas, stablecoins y monedas emitidas por los bancos centrales.

PRIVACY AND DATA PROTECTION POLICY

Personal Data Breach: Means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access to the Shared Personal Data. Shared Personal Data: Means the Personal Data to be shared between the parties by virtue of this contractual relationship. Access Request: Means the right by a Customer or User to access or request a copy of the Data provided pursuant to Article 15 of the GDPR. Supervisory Authority: means the relevant supervisory authority in the territories where the parties to this Agreement are established. PURPOSE The present privacy and data protection policies, constitute the regulatory framework for the provision of Personal Data made by the Customer or the User. Likewise, these policies define the principles and procedures to which users must adhere and the responsibilities to be assumed during the commercial relationship. FUTSWAP requires the personal data of clients and users for the fulfillment of its obligations and diligences pertinent to the registration and knowledge of the client and to comply with the legal obligations of prevention of Money Laundering, Financing of Terrorism and Transfer of Funds (Information on the Payer) Regulation 2017 and other related legislation. FUTSWAP undertakes to process the customer's and user's personal data only for the following purposes:
    • (a) FUTSWAP's performance of its obligations under this business relationship; (b) Complying with all of the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 and any other applicable legislation. FUTSWAP will not process Users' personal data without the User's prior permission for purposes other than those previously stated.FUTSWAP will ensure users' compliance with applicable national data protection laws at all times during the term of the business relationship. It is noted and should be noted that in the event of a conflict between the data protection law of the United Kingdom and the data protection law of the customer's country of domicile, the law of the country that provides greater protection for the privacy and personal data of users will be preferred.SHARED PERSONAL DATAThe following types of Personal Data will be shared by users during the Term of the business relationship: name, address, date of birth, identification document numbers (such as driver's license or passport), photograph of the Customers (if natural persons) and of the directors and beneficial owners of the customer (if legal entities). SECURITY AND DATA PROTECTION User will only provide Shared Personal Data to FUTSWAP using secure methods.
